1. Acceptance of Terms
GoodData is a behavioral analytics and user intelligence platform. By installing our tracking script or accessing our dashboard, you agree to be bound by these Terms. If you are using GoodData on behalf of an organization, you agree to these Terms on behalf of that organization.
2. Description of Services
The "Active Spy" Engine
GoodData provides advanced heuristics to analyze user behavior. You acknowledge that our services include:
- Behavioral Tracking: Recording mouse movements, clicks, scrolls, and hesitation patterns.
- Intent Detection: Inferring user intent via heuristics (e.g., Screenshot detection, Copy/Paste tracking, Rage clicks).
- Data Visualization: Aggregating this data into dashboards and heatmaps.
3. User Responsibilities (Data Controller)
Under GDPR/CCPA, you are the Data Controller and GoodData is the Data Processor. By using our script, you agree to:
- Obtain Consent: You ensure that your website's privacy policy discloses the use of behavioral analytics and obtains necessary user consents (e.g., cookie banners) where required by law.
- No Sensitive Data (PII): You agree NOT to use GoodData to collect passwords, credit card numbers, health data, or government IDs. You are responsible for ensuring your HTML inputs are properly masked or excluded if they contain sensitive info.
- Lawful Use: You will not use the "Active Spy" features to harass users, facilitate cyberstalking, or violate wiretapping laws in your jurisdiction.
4. Limitations of the Tracking Script
You acknowledge that:
- The "Screenshot Detection" is a heuristic (best-guess) based on browser events and OS patterns; it is not a kernel-level guarantee.
- Ad-blockers, Do-Not-Track (DNT) signals, and privacy extensions may block the GoodData script. We do not circumvent these user choices.
- We do not guarantee 100% data accuracy for billing or mission-critical auditing purposes.
5. Intellectual Property
The GoodData tracking code, heuristic algorithms, and dashboard UI are the exclusive property of GoodData. You are granted a limited, revocable license to use the tracking script solely for the purpose of analyzing your own web properties. Reverse engineering the "salt rotation" or fingerprinting logic is strictly prohibited.
6. Termination
We reserve the right to suspend or terminate your account immediately if we detect:
(a) Malicious use of the tracker (e.g., XSS attacks, keylogging);
(b) Excessive API usage that degrades platform stability; or
(c) Failure to pay subscription fees.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS". GOODDATA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE ANALYTICS WILL BE ERROR-FREE OR THAT THE "ACTIVE SPY" FEATURES WILL DETECT EVERY USER INTERACTION.
